[vc_row][vc_column][vc_column_text]De verdachte Jos Brech is aangehouden in Spanje. Nu laait de discussie op omtrent zijn DNA. Is dit DNA rechtmatig afgenomen of niet. Feit is dat het DNA is afgenomen in de vermissingszaak die werd gestart. Onduidelijk is nu of dit DNA dan ook gebruikt kan of mag worden in de strafzaak.<\/p>\n

Het Openbaar Ministerie is ervan overtuigd dat het dna-materiaal van Jos Brech rechtmatig is verkregen.<\/p>\n<\/div>\n

Zij ontkent niet dat er gewerkt is met materiaal uit de vermissingsonderzoek naar Jos Brech, maar stelt dat er daarnaast ook op andere manieren een match is verkregen.Wet<\/strong>
\nRechtspsycholoog Peter van Koppen uitte forse kritiek op de werkwijze van het OM. Volgens hem is het dna-materiaal dat de politie kreeg in verband met de vermissing van Jos Brech, gebruikt om hem te kunnen arresteren in de zaak van Nicky Verstappen. En dat is wettelijk niet toegestaan. Spoor<\/strong><\/section>\n

Volgens het Openbaar Ministerie kwam ze Brech op het spoor nadat hij diverse malen niet reageerde op de oproep om vrijwillig dna af te staan in het grootscheepse verwantschapsonderzoek. Omdat de politie wist dat hij als passant op de de plaats delict was gesignaleerd \u00e9n in het verleden betrokken was bij een zedenzaak, trok hij de aandacht.Verre familie<\/strong>
\nDe agenten zijn vervolgens op zoek gegaan naar verre familieleden. „Uiteindelijk zijn twee mannen uit de vierde en vijfde familielijn gevraagd om vrijwillig dna af te staan in het onderzoek van Nicky Verstappen. Deze mannen werkten mee en er bleek een volledige match te zijn met de sporen die op het lichaam van Nicky Verstappen zijn aangetroffen“, zegt hoofdofficier Jan Eland tegen L1.<\/section>\n

Doorbraak<\/strong>
\nTijdens de persconferentie van vorige week, waarbij de doorbraak in de zaak wereldkundig werd gemaakt, sprak Eland over drie verzamelde dna-profielen: het dna van de verwanten, genetisch materiaal dat werd aangetroffen op spullen van Brech in Nederland \u00e9n dna uit de vermissingszaak. Eland zegt echter niet expliciet in welke volgorde de drie dna-profielen bij het onderzoeksteam terecht zijn gekomen. En dat lijkt dus wel een cruciaal punt te zijn als het gaat om de rechtmatigheid van het verkregen bewijs.\u00a0<\/section>\n

Vormfout<\/strong>
\nPolitie en Justitie werken al 20 jaar aan de zaak en zijn er dus op gebrand om hem eindelijk op te lossen. De grote vraag is dus of de politie \u00fcberhaupt het risico wil nemen met bewijsmateriaal dat bij een rechter mogelijk sneuvelt. Volgens oud-toprechercheur John Vullers<\/strong> kan het zo zijn dat de politie dit risico wel wil lopen<\/strong>. „Het kan goed zijn dat het onderzoeksteam als voornaamste doel voor ogen heeft dat de nabestaanden de langgehoopte duidelijkheid krijgen. Wellicht sneuvelt het bewijs in de rechtszaal omdat het dna onterecht verkregen is, maar dan blijft overeind dat er een match is“, zegt Vullers. „Ik kan me die afweging als rechercheur goed voorstellen en zou op de koop toenemen dat je mogelijk een vormfout hebt gemaakt.“Lees ook:<\/strong> Advocaat: ‚Jos Brech binnen twee dagen in Nederland‘<\/a><\/section>\n

Overigens zal Jos Brech zodra hij over enkele dagen in Nederland aankomt, door agenten gevraagd worden om vrijwillig dna af te staan. Weigert hij, dan kan de rechter-commissaris hem ook dwingen.<\/section>\n<\/div>\n
